More Early iPhone and iPad Prototype Designs Surface in Samsung Trial Documents

Last week, we noted that documents filed as part of the ongoing lawsuit between Apple and Samsung had revealed a few images of early iPhone prototype designs, including some that revealed similar design to what ultimately appeared years later as the iPhone 4/4S.

AllThingsD has now put together a gallery of dozens of images from the court documents showing even more of Apple's ideas for the iPhone and iPad.

Among the many filings on Saturday was a document with dozens of sketches and prototypes for both the iPhone and iPad. Some had already been included in earlier filings, but Saturday?s collection was particularly extensive.

The filing features a host of sketches, images from computer-aided design programs, and photographs of actual models that Apple fabricated as part of its design process.



Among the concepts that had previously surfaced was a series from Apple's Shin Nishibori, whose early Sony-inspired designs were immediately leapt upon by Samsung as evidence that Apple had copied the iPhone design from earlier innovators. But as noted by The Verge, additional prototypes dating even further back show that Apple had the iPhone aesthetic well in hand even before the Sony-inspired designs were created as a side project.

"Purple" dates back to August 2005 ? months before the Jony prototype was originally designed. According to the documents, Shin Nishibori's Sony-style touches were simply "an 'enjoyable' side project," embellishments on a concept Apple had already designed. The documents contend that Purple remained free of the alleged Sony inspirations, ultimately giving birth to the iPhone in 2006 (and looking decidedly like the iPhone 4).

ReDigi takes out loans as EMI legal battle continues | Daily Serps

As controversial MP3 resale service ReDigi continues to battle a lawsuit launched by EMI, Digital Music News has noted that the tech start up has recently secured an extra $760,000 in funding.

ReDigi insists its service complies with US copyright law, mainly by relying on the so called ?first sale doctrine?, while EMI argues that ReDigi just helps others to commit copyright infringement.

While ReDigi won round one of the legal battle ? when EMI failed to get its summary judgement ? at the time various commentators wondered whether the start-up had the funds available to fight such a complicated lawsuit, even if ultimately the courts ruled in its favour. such speculation grew when the firm?s lawyer quit the case, implying some bills remained unpaid. But the tech firm insisted it could see the case to its conclusion, adding that it had switched lawyers to bring in representatives particularly experienced in this area of law.

The new loans will help with that plan presumably, though whether it will be enough to allow ReDigi to weather this storm and grow its business remains to be seen.

Laclede Group profit, sales decline from 2011

ST. LOUIS (AP) ? The Laclede Group Inc., owner of Laclede Gas Co., said Friday that fiscal third-quarter revenue dropped sharply and profit fell 45 percent compared to last year, when asset sales boosted earnings.

Excluding that 2011 gain, the company said adjusted earnings rose 5 percent over last year.

Revenue plunged to $186.8 million from $344.3 million, which the company blamed partly on mild weather that hurt results at its gas-distribution utility.

Net income was $8.4 million, 38 cents per share, but would have been 40 cents per share excluding losses from derivatives, the company said. That was down from income of $15.4 million, or 69 cents per share, a year earlier, when the sale of excess propane inventories added $6.1 million or 27 cents per share to earnings.

Laclede Group, based in St. Louis, has about 625,000 residential and business customers in that area.

In afternoon trading, Laclede Group shares rose 57 cents at $41.36.

Government on track with federal health exchanges: official

WASHINGTON (Reuters) - The Obama administration on Friday said it is on track to set up federal health insurance exchanges by 2014 in U.S. states that fail to establish their own regulated insurance markets under the U.S. healthcare reform law.

The Health and Human Services Department is also preparing to issue new guidance for states before the end of the summer on how federally facilitated exchanges are expected to operate, a senior official said.

"We realize that not all states will be ready to establish these exchanges by 2014, so we are on track to set up the federally facilitated exchange in those states. It is on track to go live," said Mike Hash, the senior official overseeing the administration's health exchange effort at HHS.

His remarks come at a time of mounting tension between the administration and some states over the exchanges and other provisions of President Barack Obama's healthcare reforms.

The reform law known as the Patient Protection and Affordable Care Act calls on states to create regulated exchanges where an estimated 16 million uninsured Americans are expected to qualify for private health coverage at rates subsidized according to income via federal tax credits.

Tax credits would be available for a family of four earning up to $88,000 a year.

The Affordable Care Act survived a major legal test a month ago when the U.S. Supreme Court upheld the law as constitutional but allowed states to opt out of an expansion of the Medicaid program for the poor.

But the reform provision on exchanges has since become an election year flashpoint for several Republican governors who reject the plan, along with the Medicaid expansion, as too costly and bureaucratic.

Officials in still more states are waiting to see who wins the November election before taking action.

Republicans, led by their party's presumptive presidential nominee, Mitt Romney, are vowing to repeal "Obamacare" if they win big in November's general election.

State resistance to the exchanges, spearheaded by the governors of Florida, South Carolina, Louisiana, Mississippi and Texas, has been largely overshadowed up to now by the concurrent fight over Medicaid, which would extend coverage to an estimated 11 million people who are now uninsured.

MISSING THE BOAT?

Speaking at a Capitol Hill conference on health reform, Hash said the administration wants as many states as possible to set up their own exchanges but has begun testing a federal exchange model that can be rolled out "in any number of states."

HHS is scheduled to host a series of meetings across the country to discuss reform issues with state representatives and others. It has scheduled forums in the District of Columbia, Atlanta, Chicago and Denver from August 14-22.

Thirty-five states have accepted a total of $850 million in federal grants to plan and establish state exchanges. But only 13 and the District of Columbia have declared their intention to establish their own marketplaces.

According to the Commonwealth Fund, a private foundation that promotes healthcare system improvements, 24 states have taken no action toward establishing an exchange while eight others have declared that they will not pursue one.

The administration has set a November 16 deadline for states to say whether they intend to set up their own exchange, create one in partnership with the federal government or let federal officials establish one for their residents.

Initial enrollment is due to begin nationwide in October 2013, three months before the Affordable Care Act's provisions come into full force on Jan 1, 2014.

The National Association of Insurance Commissioners, which represents insurance regulators in all 50 states, says state governments that opt for federal exchanges risk losing control of lucrative private health insurance markets within their borders.

"If the states do not get ready for this, then they lose the ability to regulate. It's the whole marketplace," Brian Webb, NAIC's health policy and legislation manager, told the forum hosted by the nonpartisan Alliance for Health Reform.

"They may get their wish and not be able to do anything in their marketplaces," he said. "There's not an insurance commissioner in the country who wants to say, 'No, we're not going to regulate that.'"

Tim Jost, a health law expert at Washington and Lee University, warned the same audience that inactive states may already have "missed the boat" for establishing their own exchanges on schedule.

The job involves myriad tasks ranging from establishing eligibility guidelines for consumers to establishing information technology systems and certifying qualified insurance plans.

"If you work backwards from October (2013), you get almost to the present," said Jost, who believes most states will wind up with federal exchanges in 2014 then transition to their own operations over time.

Wondolowski nears scoring record

Thierry Henry, David Beckham, Landon Donovan have the names that will dominate conversation tonight from Major League Soccer?s side as the All-Stars do their thing against European champion Chelsea. (Coverage begins at 8:30 p.m. on ESPN2)

Chris Wondolowski? He?s one of the All-Stars of lesser brilliance in the greater cultural stratosphere. Soccer fans know all about the San Jose Earthquakes prolific scorer, but the general public may stare past the man known as ?Wonder Wondo? as they tune in tonight.

It takes an extended run with the national team or a move overseas to a fancy, name brand league to jump the divide in Q Score.

Or, perhaps it could happen for a man who sets the long-standing single season scoring record; Wondolowski may just be the fellow to do it.

Light-activated brain cells boost monkey skills

Treating disease by stimulating brain cells with light is a step closer to reality following the first demonstration that the technique can improve mental performance in monkeys. Two monkeys performed better on simple computer tasks after light was used to boost the activity of brain cells necessary for the task.

"For the first time, we were able to change behaviour in primates with our technique," says Wim Vanduffel of Massachusetts General Hospital in Charlestown, who is head of the group that performed the experiment.

Known as optogenetics, the method has the potential to treat conditions such as epilepsy, where the light could temporarily deactivate the brain cells that cause seizures, or Parkinson's disease, where it can activate cells that make dopamine, the neurotransmitter vital for controlling mobility that those with Parkinson's lack.

Previously, it has been used in nematode worms to trigger them to lay eggs, and mice to relieve depression and paralysis. Researchers have also used it in monkeys, but only on single, isolated neurons. Vanduffel and his colleagues wanted to see if they could extend this to entire networks of cells, boosting a monkey's ability to perform a simple computer-based task.

Natural performance enhancers

First, Vanduffel's team scanned the two monkeys' brains using functional magnetic resonance imaging while they followed a green dot on a computer screen. From the scans, the researchers could tell that the monkeys relied on an area of the brain called the arcuate sulcus to do the task.

Next, the team inserted a gene that reacts to light into the cells of the arcuate sulcus. Originally from algae, the gene makes a protein called channelrhodopsin-2, which reacts to blue light by admitting ions into the brain cells, activating them in the process. They gene was ferried into the cells using a virus.

Finally, the team guided fine, light-conducting needles into the same area through a port permanently attached to the animal's skull. The monkeys then repeated the task as the researchers pumped light into their brains.

Comparisons of the monkeys' performances before and after the treatment showed that they reacted about 10 per cent faster when undergoing light stimulation. "One monkey reacted about 20 to 28 milliseconds faster, and the other about 15 milliseconds faster," says Vanduffel.

Vanduffel says that in unpublished experiments, monkeys undergoing the technique while carrying out a more complex task improved even further. "My hunch is that the harder the task, the more significant the effect," he says.

Proof of principle

"This is just proof of principle, and there's a very, very long way to go before we can start using it in humans," he adds.

Although treating humans is a distant prospect for now, Vanduffel says the method is evolving fast. Gene switches have been identified that work in very specific brain areas, potentially enabling light to target unhealthy cells without disrupting healthy ones.

"This work is exciting because they've shown that pre-stimulating an area of the brain necessary for the task makes processing faster," says Arnd Pralle of the State University of New York at Buffalo, who uses magnetism instead of light to activate brain cells in worms.

Another important advance, says Pralle, is that whole networks of cells were activated for the first time, compared with single or small groups of neurons stimulated in previous monkey and rodent experiments.

There are certain things you can do to improve your chances of getting an interview, and other things that may hinder your job search. Here are some job-search techniques that you should try to avoid if you want to improve your chances of getting hired.
1. Submit to new job postings that are already old
Many jobs that get published have already been circulating for a while. Employees within the company will be asked if they know anyone who's good for the position. Headhunters will be contacted. Word-of-mouth spreads the job. By the time you see the job in the classifieds and apply, candidates from far and wide have sent in their resumes, and you're already at a disadvantage. The job may simply be posted so that the company can be seen to be offering equal opportunities to everyone. So if you really want a job in a certain field or company, be proactive. Get to know the hiring managers or HR people. Do some cold calling. Ask around. You want to be fishing for the best jobs before they're announced to the masses.

2. Send out masses of unsolicited resumes
This was a tactic a friend of mine employed as we were finishing college, and it did not work. The mass-mailing is usually fruitless and can waste a great deal of your time and money. It may also irritate hiring managers and these resumes usually end up in the trash.

3. Assume that if there's no job posted, it means there?s no job available
A lady friend of mine applied for a sales job through a recruitment company. She did well in initial interview and was shortlisted for the final interview. The position she applied for was sales while in the interview a member from the recruitment company on the interview panel realized that she had a good education in Human Resource. She was given a job in the recruitment company.
The moral of this story, whether it's true or "inspired," is that opportunities present themselves everywhere. You can't assume that the only jobs around are the ones that are advertised. Your skills could be perfect for a company and they may not even know they need you yet. Keep your eyes and ears open, be inventive and be proactive. You never know where it may lead you.

4. Apply for more jobs to increase your odds
Here's another common error. "If I apply for 100 jobs, I'll get more interviews and that will mean more chances of getting hired." Well, not really. If you're sending standard cover letters and CVs to every job that sounds remotely interesting, you'll fail to get noticed by any of the hiring managers. You're basically hoping that your CV gets picked from an enormous pile and you get the call. You need to be smarter; be targeted. Pick out the jobs you really want and write cover letters and resumes that are tailor-made for those jobs. Do your homework. Find out everything you can about the industry, company and role then make an application that cannot be ignored. Now, you're not relying on chance any more. In this day and age, quality is far better than quantity.

5. Have only one resume and cover letter
This is related to the previous tip. Competition for an opening is very high. So do not ever rely on one standard CV and cover letter for every job you apply for. Job searching is hard work; some say it's a full-time job, so you cannot just make 20 copies of both your cover letter and CV application and apply for 20 different job postings.? Worse still, if you do apply online or via email, a simple copy and paste may not be good enough. Focus. Find out how the company operates, what is required for that job and the challenges they face. Present yourself as a solution to the companies need. It proves you're a step ahead and do nothing by halves.

6. Rely on just one job search technique
It's great to check a site like JobsKenya.com every day. But don't pop online, see what's new, and then log off. It's outdated thinking to expect the ideal job will be in the one place you're looking. This is the age of digital networking, featuring FaceBook, LinkedIn, Twitter, Google + , and so much more. Dive into them all. The perfect job could be lurking inside any one of them.

7. Focus on yourself
What? But it's all about you, right? Not exactly it's all about the employer. They're like a first date and they want to know how interested you are in them, not yourself. It may have worked well in the past, but that kind of "me, me, me" attitude does not sit well with employers these days. Let them know how you fit in with their organization. Show them why you would make a great addition to their team. Set your sights on making the employer feel like they're the only company you'd ever want to work for, because they're the perfect fit. When you focus on them, they focus on you.

8. Refuse to change careers
Remember the days when people were accountants at one company for 30 years and then got a golden handshake at a retirement? Those days are gone. Nowadays, there is rapid and constant changes in technology as well as new careers are springing up all the time. There was a lady who was a secretary for over 20 years, because of the importance of her role which required a great deal of work to be handled manually, the demand for secretaries was great and their salary was also good. With the introduction of IT in the office and use of networked phones employees are now more independent. Unfortunately, the lady was on a salary that was close to Ksh 100,000 a month. Her skills and role were obsolete. With some retraining however, such as business administration, human resource or accounting she could make herself relevant. How many jobs are out there now that weren't around 10 years ago? Or even 5? For instance, social media is now booming. It employs many people. They had to come from somewhere and no doubt they switched career paths. While you shouldn't cast your net so wide, as to be fruitless, consider fields that are related to yours in some way.

What did happen was a?most lovely, sweet affair, in our backyard with?most of our nearest and dearest. I?l be the first of any to proclaim the?many virtues of all that is DIY.?Especially?when it comes to anything baby, toddler, house and home related. And obviously food/drink recipes. (Hello Pinterest,?my sexy BFF).

As we?momma?s know, life in the land of baby and toddler takes on a carnivalesque hue at times. Wherein we just don?t have the time to put?Martha Stewart to shame. Which is fine, because our babies?

They. Don?t. Care.

You could stick a candle in a?McCain cake, let them roll around naked and have those who love and dote upon them the?most show up. That right there is all they need and/or know about a party in their honour being awesome. Oh, and the presents. But that bit doesn?t come until later.

I guess what I?m trying to say, is all of these grand birthday parties are really for us. The adults. And the expectation of presents, well ? that all up to us to. These little humans after all, are essentially?moulded by us. So, what?may be cute when they are younger? (Ripping open a mountain of pressies). Will be far less so when they start to demand or expect it, often skulking when they don?t get it. We?ve all heard the term, ??I?ve created a?monster?.

?Nuff said.

It should also be?mentioned that technically, Abby doesn?t turn 1 until this Thursday ? we had her grand hoopla of a party earlier to accommodate guest RSVP?s. So you?can expect to be hit with another round of epic cuteness come the actual day of her birth. Until then though,?may your ovaries (or other baby-loving parts) be tickled by these?

New probe provides vital assist in brain cancer surgery

ScienceDaily (July 24, 2012) ? Performing surgery to remove a brain tumor requires surgeons to walk a very fine line. If they leave tumor tissue behind, the tumor is likely to regrow; if they cut out too much normal tissue, they could cause permanent brain damage.

"Primary brain tumors look just like brain tissue," says Keith Paulsen, PhD, a professor of biomedical engineering at Thayer School of Engineering and a member of the Cancer Imaging and Radiobiology Research Program at Norris Cotton Cancer Center. "But if you look at them under a particular kind of light, they look much different."

To improve their ability to differentiate between tumor cells and healthy tissue, surgeons can have patients take an oral dose of the chemical 5-aminolevulinic acid (ALA). An enzyme metabolizes ALA, producing the fluorescent protein protoporphyrin IX (PpIX). Tumor cells have a higher metabolic rate than normal cells, so they accumulate more PpIX -- and therefore fluoresce, or "glow," when exposed to blue light.

A cancer "flashlight"

But this method was thought to be not sensitive enough to highlight brain tumors that are less metabolically active, like low-grade gliomas. To address this problem, MD-PhD student Pablo Valdes, PhD, and his research mentors -- David Roberts, MD, the chief of neurosurgery at Dartmouth-Hitchcock Medical Center, and Dr. Paulsen -- used a probe (which they helped develop) that combines violet-blue and white light to simultaneously analyze both the concentration of PpIX and four other tumor biomarkers: PpIX breakdown products, oxygen saturation, hemoglobin concentration, and irregularity of cell shape and size. The probe reads how light travels when it hits the tissue, sends this data to a computer, runs it through an algorithm, and produces a straightforward answer as to whether the tissue is cancerous.

"Our big discovery is that we can use the probe's reading of the fluorescing agent to measure the existence of a low-grade tumor in tissue," says Dr. Paulsen. "The probe is basically an enabling technology to show that information to the surgeon -- a visual aid."

He says that when they first saw the results of using their fluorescing agent and probe on low-grade brain tumors, it was "jaw-dropping. The tumor glowed like lava."

The Thayer/Norris Cotton Cancer Center/Dartmouth-Hitchcock Medical Center team, which has been working on the brain probe for about six years, built on research that was originally conducted in Germany about 15 years ago. But the German research did not focus on low-grade tumors. The assumption, Dr. Paulsen says, was that, due to the blood-brain barrier, low-grade tumors did not have enough PplX and therefore would not fluoresce.

In a pilot study, Roberts operated on 10 patients with gliomas. He used a microscope throughout the surgery to see the fluorescence and used the hand-held probe to evaluate sections of the tissue where the fluorescence was not definitive. After the surgeries were complete, a pathologist evaluated how accurately the probe had identified tumor tissue.

Striking results

The results, published in the Journal of Biomedical Optics, are striking. Diagnoses based on only fluorescence had an accuracy of 64 percent. But when Roberts used the probe as well, the accuracy increased to 94 percent, meaning that Roberts was much more successful in differentiating between tumor tissue and normal tissue. Although the study was small, it introduces a promising method to help surgeons remove only what they want and nothing more.

Dr. Paulsen says that a protocol is in place for a similar study on lung cancer tumors. He thinks the brain probe may have applications for other cancers as well, but for now the research will have to proceed one cancer type at a time.

Ion Torrent vies for $10 million genome prize

NEW YORK (Reuters) - A genome-sequencing contest announced six years ago finally has its first entrant: Life Technologies Corp.'s Ion Torrent, which on Monday said it was entering the fray.

The Archon Genomics X Prize will award $10 million to the first team that sequences the complete genomes of 100 people aged 100 or older in 30 days or less, for no more than $1,000 each, and with an error rate of no more than 0.0001 percent.

No one else has been game since the contest was announced in 2006, when it would have taken 33 years and $100 million to do 100 genomes, estimates Ion Torrent founder and CEO Dr. Jonathan Rothberg. In January, the company said its Ion Proton Sequencer was ready to sequence a complete human genome in a day at a cost of $1,000.

"I can think of two reasons why companies have not signed up," said geneticist Craig Venter, who led the private sector effort to sequence the complete human genome, finishing in a dead heat with a government-backed project in 2000. He serves as a trustee of the foundation that created the prize.

"One is that $10 million isn't a significant sum to them. But when I look at their stock price I see that's actually a good fraction of their market capitalization," he said of companies like Life Technologies and Illumina. "The other reason is that, despite what their ads say, their technology doesn't measure up. I regard the X Prize as truth serum."

No other genome-sequencing companies contacted by Reuters said they intended to compete for the centenarian X Prize. Besides the cash and bragging rights, the company that sequences the genomes of 100 centenarians could stumble on some fascinating science and new leads in drug discovery.

"Illumina does not plan to participate," said a spokeswoman for the company, which fought off a takeover attempt by Roche Holding AG earlier this year. In January, Illumina announced that its next-generation sequencer, HiSeq 2500, will be able to sequence a human genome in about a day.

"We haven't entered so far and haven't announced any intention to do so for the time being," said a spokeswoman for privately held Oxford Nanopore Technologies Ltd., which caused a stir at a technology conference in February when it unveiled a device the size of a USB memory stick capable of sequencing 150 megabases of DNA per hour. The human genome has 6 billion bases, or chemical "letters" that spell out genes.

"We're waiting to learn more before deciding whether to join," said Dr. Clifford Reid, president and CEO of Complete Genomics Inc., which provides whole-genome sequencing services. Reid wants assurances that there will be "a level playing field and an unbiased measure of accuracy" so error rates are calculated in a way that's fair to each competitor.

That leaves Ion Torrent.

"All the numbers work," said Rothberg. "We'll have eight Protons (sequencers) running at a dedicated facility with about a dozen people, and we'll be able to sequence up to 100 billion bases every two hours."

That raw data must be assembled into their order on the 23 human chromosomes, a task analogous to putting the pages of the New York City phone book into the right sequence. The assembly process will take Ion Torrent most of the 30 days it has under X Prize rules.

HIGH-STAKES SCIENCE

The Archon prize is administered by the nonprofit X Prize Foundation, which was founded in 1995 to create and run high-stakes scientific competitions. Its name refers to Archon Minerals Ltd., a Canadian mining company whose president, Stewart Blusson, and his wife, Marilyn, funded the prize.

Express Scripts Holding Co., a pharmacy benefits manager, provides financial support for the prize's operations, which include developing an "answer sheet" (the correct genome sequences of the centenarians), said the foundation's Grant Campany.

Other companies have until May 31, 2013 to enter the ring. The countdown will start on September 5, 2013, when a judge from the foundation will deliver vials containing the DNA of 100 centenarians to each sequencing team. Each will have until October 4 to determine the 100 genome sequences, with the winner determined by accuracy.

While many studies that identify gene variants uncover those that increase the risk of disease, sequencing centenarians' genomes "will tell you about alleles (gene variants) that don't cause disease," said Rothberg. "These people don't have cancer, they don't have Alzheimer's disease, they don't have hypertension, they don't have heart disease."

That could yield promising new targets for drug development, with the aim of replicating the action of gene variants that protect the body against all kinds of ailments.

In fact, centenarians - who make up 0.2 percent of the U.S. population, or about 53,000 people - don't have a notably healthy lifestyle.

A 2011 study of 477 people aged 95 and older found that they are just as likely as the general population to have been overweight at any point in their life, to have smoked and drunk alcohol, and to have eaten a high-fat diet.

"Our centenarians - including one 107-year-old who runs a hedge fund - were no more likely to have followed healthy practices," said Dr. Nir Barzilai of Albert Einstein College of Medicine in New York City, who proposed the centenarian-genome contest to the X Prize Foundation.

Barzilai and colleagues also found centenarians are as likely as everyone else to have genes associated with cardiovascular disease and other life-shortening illnesses. But like their "unhealthy" lifestyle, their "disease genes" don't seem to hurt them.

That suggests what Barzilai calls a ??buffering'' mechanism in which "longevity genes might counter the disease genes and the unhealthy lifestyle."

Anyone born before September 5, 1913, can volunteer their DNA through the X Prize's website.
