Hundreds attend funeral for slain Montana teacher

(AP) ? Residents of a tight-knit eastern Montana town mixed calls for justice with sorrowful relief Friday as they mourned a high school teacher who was kidnapped, strangled and her body buried in a shallow grave discovered after two months of searching.

Hundreds of people filled the Sidney High School gymnasium for Sherry Arnold's funeral, held in the same school where Arnold taught for 18 years, where her husband Gary still teaches and her two children attend classes.

The mourners took their seats under flickering images of Arnold and before a casket covered by roses and a Chicago Cubs baseball cap for her favorite team.

Arnold went missing after going for a jog on the morning of Jan. 7. Prosecutors said she was kidnapped by two men from Colorado who had arrived looking for work in the oil fields.

The brutal killing shocked the Sidney community that was already dealing with the growing pains of the nearby boom in the North Dakota oil fields.

Some said they were relieved that her body was found so that they could have closure. Some said they wanted to see their beloved teacher's killers punished.

"We want to see justice," Cody Schroeder, a junior at the high school and one of Arnold's past students, told the Billings Gazette (http://bit.ly/H1w0fR).

The Rev. Ned Shinnick told the mourners that instead of vengeance, they should focus their energy and love of Arnold on building up the community.

"I hear there are thoughts of vengeance," he said. "What does vengeance really do? Let us not think of revenge. Let us not think of violence."

Shinnick, a priest with St. Matthew's Catholic Church, spoke of Arnold's athletic prowess and her influence in the community and said she was taken in her greatest hour.

For many, the service reopened wounds not yet healed from the weeks Arnold was missing.

"She meant so much to all of us," said Cheryl Moran, whose children learned math from Arnold. "It's a relief they found her body. But it drags up the feelings of two months ago."

Michael Spell, 22, and Lester Van Waters Jr., 48, were arrested a week after Arnold's disappearance. Prosecutors have said Spell told investigators that he pulled Arnold into a car and Waters choked her to death before burying her in a shallow grave on a farmstead near Williston, N.D.

Spell tried to lead FBI agents to the burial site but failed. The search went on until Arnold's body was found near Williston last week.

Spell and Waters have pleaded not guilty to aggravated kidnapping and await trial. The men, both from Parachute, Colo., were being held on bail of $2.5 million each.

Several businesses closed and classes ended early for the funeral, and the 2,000-person capacity gymnasium was nearly filled.

Sidney Public Schools Superintendent Dan Farr extended his condolences to Arnold's husband, Gary, and to her parents, Ron and Sharon, and to her children. He also praised the community for the support it has shown over the last two months.

"I look out on the gym today and I can only feel proud," Farr said. "Your actions, your emails, even the little hugs, have meant so much to the family, to staff and to students."

Arnold was buried at the Sidney cemetery after the service.

BUILDING LOCAL WEALTH II ? REPORT ? Willits Economic ...

Enthusiasm was high at the second forum on building local wealth sponsored by Willits Economic Localization (WELL) on March 25th.

The question underlying this event was whether WELL should play a role in stimulating or managing a connection between local investors and local entrepreneurs. Holly Madrigal, who serves on the Willits City Council in addition to the WELL coordinating committee, introduced and facilitated the forum.

Three experts in aspects of local finance and economic development presented for the first hour, followed by more information, ideas and interest in investing from some of the 50 or so in attendance.

Richard Cooper is director of the Mendo-Lake Credit Union (MLCU) and a board member of the Economic Development & Finance Corporation (EDFC), a non-profit organization that channels federal grants and loans to businesses in Mendocino County. Cooper noted that the MLCU has expanded greatly in the past few years, including noticeably after the Occupy Wall Street movement encouraged people to transfer their accounts to local institutions. Their focus is consumers: mostly auto loans, some home loans, and personal loans up to $20,000 that could be used for small start-up businesses. At the moment, they have a surplus of funds with not enough qualified borrowers.

he EDFC, on the other hand, is focused on job-creating business loans. There are success stories, such as the Gualala food co-op and [FILL IN].
However, as a ?lender of last resort,? these investments are higher risk, and there have been some failures, especially in recent hard economic times. John Kuhry, director of EDFC, noted that they currently have about $300,000 in funds not yet allocated to eligible businesses.

Both Cooper and Kuhry stressed their responsibility to wisely manage these public funds and to earn the public?s confidence. In addition to careful vetting of business plans, they often partner with other investment groups, such as the Arcata EDFC and local banks, to minimize the potential impact of a failed investment on any single institution. Richard Willoughby, of North Valley Bank, is one such partner interested in local investments.

Andy Schexnaydre is on the board of GoLocal Sonoma County and a socially-responsible financial planner. His prior experience included work for the Pacific Stock Exchange, UBS, and Financial West, ?all of which,? he noted, ?have their decision-making headquarters far away from local communities.? To illustrate the contrast, he showed an excerpt of ?It?s a Wonderful Life? in which George Bailey, the local banker, pleads with his patrons to have faith in the interactions that benefit both borrowers and lenders ? and the community ? at the local level.

Schexnaydre pointed out the traditional banking formula (that George Bailey operated under), where investors get 3% return, borrowers pay 6%, and the bank makes a 3% profit. ?In the 1970s,? he noted, ?Wall Street?s profit margin climbed to 15%. In 2007, it was 40%. That leaves investors with nearly 0% return, and borrowers paying exorbitant rates.?

?In February 2012,? Schexnaydre continued, ?five business giants agreed to a $25 billion settlement, with no criminal charges, for mortgage fraud ? after that fraud had contributed to an estimated $700 billion in real estate losses.? He rattled off some alphabet soup of the kinds of financial transactions that continue to run rampant on Wall Street, virtually none of which benefit local businesses or jobs.

?Some of the new ideas for local economies include ?crowd-funding,?
time-banking, and cooperatives,? said Schexnaydre. ?You have to be careful, but don?t be intimidated. Lending institutions are highly regulated, but individuals or small groups of private investors have lots of leeway.?

John Sakowicz, host of KZYX?s All About Money show, a past dealer on Wall Street, and recently appointed to the County Employees Retirement Board, was the third presenter. The MCERA manages investments of $352 million to secure retirement benefits for the County?s employees.

?When I was interviewed for appointment to the board, Supervisor Dan Hamburg asked what I thought of investing 1% of these funds locally,? recounted Sakowicz. ?My first reaction was that might conflict with my responsibility to protect the employees investment. But then I realized that local micro-loans, in partnership with EDFC and other banks, could be both safe and beneficial ? to the fund as well as the community.?

?When I brought up this idea to the MCERA,? he continued, ?I got blank stares.? Sakowicz urges citizens to lobby their Board of Supervisors and Shari Shapmire, County Treasurer, if they would like to see $3.5 million directed from this fund to invest in local job-creating businesses. He cited several precedents of pension funds successfully doing this type of alternative investment, including British Columbia, Ontario, and the States of Texas and Maryland. The California State retirement board, CalPers, has been making a 22% return on its alternative investment program of inner-city loans, for another example.

During the audience discussion, John Kuhry (of EDFC, noted earlier) mentioned that Yokayo Bio-fuels is considering a public offering to expand its business. He said that investors could choose what is coined ?patient capital? (or ?slow money?) ? keeping interest rates low and not expecting any immediate returns while a new business gets started.

Facilitator Holly Madrigal noted that the Willits Chamber of Commerce was the first Chamber to join BALLE, the nation-wide Business Alliance for Local Living Economies. ?BALLE sponsors very useful webinars and conferences to promote the kind of business-investor cooperation being explored in this forum,? said Madrigal.

Another Willits City Councilmember, Ron Orenstein, commented that his primary concern is local jobs, yielding a healthy local economy, rather than a cash yield on investments. Quite a few enterprises are interested in the ?business incubator? he is establishing at the Railroad Center. Orenstein, along with entrepreneur Ron Cole, feel there is great potential for synergy, using the wastes or bi-products of one business as the resource for another.

Keith Rutledge of REDI (Renewable Energy Development Institute in Willits) said they?re considering a program similar to Sonoma County?s PACE (Property-Assessed Clean Energy) which allows qualifying homes and businesses to finance energy improvements paid back through the property tax rolls.

Some of the other ideas brought up in the discussion session were stressing energy and food independence, choosing a ?pilot project? to invest in, or ?bundling? several businesses to encourage cooperation and minimize risk, producers and consumers co-operatives, buying local, and direct marketing.

About 3/4th of the audience members indicated interest in becoming local investors. Several WELL coordinating committee members indicated this topic will be high on WELL?s agenda this year.

(AP) ? The Supreme Court will begin hearing arguments on Monday over President Barack Obama's health care overhaul, the Patient Protection and Affordable Care Act, derisively labeled "Obamacare" by its opponents. A look at how the case will unfold before the court in question-and-answer form:

Q: What's this all about?

A: The Supreme Court is hearing a challenge to the Patient Protection and Affordable Care Act, which is Obama's signature domestic achievement. Passed by Congress in 2010, its aim is to provide health insurance to more than 30 million previously uninsured Americans, while trying to restrain costs and prevent disruptions to the majority already with coverage. Opponents say the law is unconstitutional; their chief argument is that Congress does not have the power to force unwilling Americans to buy health insurance or pay a fine.

Q: When will the court get started?

A: Justices will begin hearing arguments shortly after 10 a.m. EDT Monday, March 26. They will hear six hours of arguments on several different issues on Monday, Tuesday and Wednesday.

Q: Which issues on which days?

A: Monday's 90-minute argument is about whether court action is premature because no one yet has paid a fine for not having health insurance. Tuesday's two-hour argument will cover the central issue of whether Congress overstepped its authority by requiring Americans to purchase health insurance starting in 2014 or pay a penalty. Wednesday's arguments will be split into two parts: Justices will hear 90 minutes of debate in the morning over whether the rest of the law can take effect even if the health insurance mandate is unconstitutional and another hour Wednesday afternoon over whether the law goes too far in coercing states to expand the federal-state Medicaid program for low-income people by threatening to cut off federal aid to states that don't comply.

Q: When will the justices rule?

A: The court could decide any time, but complex cases argued in the spring normally produce decisions near the end of the court's session, scheduled for late June.

Q: Is it possible that the justices won't decide whether the law is constitutional or not?

A: It is possible. The first issue the court is discussing is whether an obscure tax law makes it too early for the Supreme Court to get involved. If they decide that the issue is premature, then the case will be dismissed without a binding ruling from the justices.

Q: What did lower federal courts say?

A: The 11th U.S. Circuit Court of Appeals in Atlanta ruled that Congress overstepped its authority when lawmakers passed the insurance mandate, the only appeals court to come to that conclusion. The 6th U.S Circuit Court of Appeals in Cincinnati upheld the entire law, as did the U.S. Court of Appeals for the District of Columbia Circuit in Washington, D.C. The 4th U.S. Circuit Court of Appeals in Richmond, Va., ruled that the question was premature and the law can't be challenged in court until after 2015, when the first penalties for not having insurance would be paid.

Q: Who are the justices on the Supreme Court?

A: The chief justice is John Roberts, who joined the court in 2005 after being nominated by President George W. Bush. In order of seniority, the other justices are Antonin Scalia (confirmed in 1986 after being nominated by President Ronald Reagan), Anthony Kennedy (1988 by Reagan), Clarence Thomas (1991 by President George H.W. Bush), Ruth Bader Ginsburg (1993 by President Bill Clinton), Stephen Breyer (1994 by Clinton), Samuel Alito (2006 by President George W. Bush), Sonia Sotomayor (2009 by Obama) and Elena Kagan (2010 by Obama.)

Q: Who will be arguing for the law?

A: Solicitor General Donald B. Verrilli, Jr. will argue for the government on Monday and Tuesday. Deputy Solicitor General Edwin S. Kneedler will present part of the government's case on Wednesday, and Verrilli will do the rest. Bartow Farr III, will also argue that if government cannot require people to buy health insurance, all other provisions of the law can go into effect. Another court-appointed lawyer, Robert Long, will also argue that the lawsuits challenging the insurance purchase requirement are premature because the penalty has yet to be imposed.

Q: Who will be arguing against the law?

A: Representing Florida on Monday will be Washington appellate lawyer Gregory G. Katsas. Former Solicitor General Paul Clement, now in private practice, will represent Florida on Tuesday and Wednesday. Former Justice Department attorney Michael A. Carvin will represent the National Federation of Independent Businesses.

Q: Can I go watch the arguments, and if I can't make it to Washington, can I watch on television or online?

A: The Supreme Court does not allow live television or radio broadcasts from inside its building, so the only way Americans can actually see or hear the arguments live is to be inside the courtroom while lawyers and justices debate. There are seats reserved inside the courtroom for members of the public on a first-come, first-served basis, with some people allowed to stay for the entire argument while others have to leave the courtroom and give their seats to the next people in line after 3-5 minutes. Q: What type of health care do the justices get, and will they be affected by their ruling?

A: The justices participate in the same health care plan as members of Congress and other federal workers. As participants in an employee-sponsored health care plan, it is unlikely that whatever decision the Supreme Court makes will substantially affect their personal health care insurance.

Q: I've heard people say that Justices Elena Kagan and Clarence Thomas should take no part in this case? What's that about?

A: Opponents of the law wanted Kagan to disqualify herself because she served as solicitor general under Obama when the health care overhaul law was conceived and passed. She has said she did not participate in crafting a legal defense for the law, but her detractors doubt her statement. Thomas' detractors insist that he should have disqualified himself because his wife, Ginni, worked with groups that opposed the new law.

Decisions to stay out of a case are the responsibility of each individual justice, and neither Kagan nor Thomas justice stepped aside.

Roberts said in his 2011 year-end report that he has "complete confidence in the capability of my colleagues to determine when recusal is warranted. They are jurists of exceptional integrity and experience whose character and fitness have been examined through a rigorous appointment and confirmation process. I know that they each give careful consideration to any recusal questions that arise in the course of their judicial duties."

(AP) ? A Marine facing dismissal for running a Facebook page called Armed Forces Tea Party that criticizes the Obama administration is still speaking out but has been getting little support from military law experts and free speech advocates who say he may have crossed the line.

Sgt. Gary Stein planned to speak at a tea party meeting in San Diego County later Thursday, a day after the Marine Corps notified him that it is moving to dismiss him for violating the Pentagon's policy barring troops from engaging in political activities.

The military has had a policy since the Civil War limiting the free speech of service members, including criticizing the commander in chief.

David Loy, of the American Civil Liberties Union in San Diego County, said he has not followed Stein's case closely, but that based on what he has seen in the media he thinks there may be a legitimate concern on the part of the Corps about Stein appearing to be speaking as a member of the armed forces because of his Facebook page's name.

"The military has a very strong interest and appropriately so to remaining neutral," he said. "The last thing we want is our military taking side on political issues."

Former Navy officer David Glazier, a professor at Loyola Law School in Los Angeles, agreed.

"He's really rubbing the government's nose in it," he said. "It's really hard to have sympathy for him."

Stein said he is not swayed. He said he received hundreds of emails from service members and the public in support of him.

"They're entitled to their opinions but I still think this is a freedom of speech issue," Stein said. "I'm standing up for the Constitution."

Stein, a nine-year member of the Corps, said he started the page to encourage fellow service members to exercise their free speech rights.

The Marine Corps said in a statement that it decided to take administrative action after Stein declared on Facebook that he would not follow unlawful orders from Obama. He later criticized the comments of Defense Secretary Leon Panetta.

According to Pentagon directives, military personnel in uniform cannot sponsor a political club; participate in any TV or radio program or group discussion that advocates for or against a political party, candidate or cause; or speak at any event promoting a political movement. Commissioned officers also may not use contemptuous words against senior officials, including the defense secretary or the president.

Stein said his statement about Obama was part of an online debate about NATO allowing U.S. troops to be tried for the Quran burnings in Afghanistan. In that context, he said, he was stating that he would not follow orders from the president if those orders included detaining U.S. citizens, disarming them or doing anything else that he believes would violate their constitutional rights.

Stein said in addition to being discharged, he would have his rank reduced to lance corporal if he is proven to be in violation. He said he was removed from his job at the Marine Corps Recruiting Depot in San Diego on Wednesday and given a desk job with no access to computers.

Stein was first cautioned by his superiors at Camp Pendleton in 2010, after he launched his Facebook page and criticized Obama's health care overhaul. Stein volunteered to take down the page while he reviewed the rules at the request of his superiors.

He said he determined he was not in violation and relaunched the page. Stein said he now plans to fight the charges. He had applied to extend his service, which was set to expire in a few months.

Former military prosecutor Lisa Windsor said since the Civil War, military members have been testing those limits and gotten in trouble. Now those cases can go global because of the Internet.

"I think they've been very lenient with him so far," Windsor said.

Stein said he will not wear his uniform when he speaks to tea party supporters but he likely will mention his case.

(AP) ? As Mike Mirski sits down with a pack of playing cards, he starts spinning the most incredible yarn. It involves a giant club sandwich, a big lily pad and a monk sitting on the moon.

None of it is true, of course. The surreal tale is just a mnemonic device enabling the 19-year-old University of Pennsylvania sophomore to remember the order of the cards in the fully shuffled deck.

It's one of several mental skills being tested Saturday at the USA Memory Championship in New York. Mirski and his Penn teammates are set to measure their recall powers against squads including four-time defending champ Hershey High School of Pennsylvania and a group of Hershey moms.

About two dozen individuals are also competing in the event, now in its 15th year. Other contests require memorizing an unpublished poem, recalling biographical information of random people, remembering rows of random numbers and matching about 100 names with faces.

Event founder Tony Dottino, a former IBM executive turned business consultant, said he established the competition as a way to promote the capabilities of the human brain.

"You are not stuck with the memory you were born with," he said.

Colette Silvestri, who has coached Hershey's team since 2008, said it's fascinating to see which techniques work best for each student on a given task. For card memorization, she said, some arrange them in specific shapes, some whisper to themselves.

"This lays it bare," she said. "You can actually see the learning styles."

Mirski, the Penn student, uses a fairly common card system in which he associates objects and images with certain suits and numbers: The ace of clubs is a giant club sandwich, the king of spades is a big lily pad, the 10 of hearts is a zen monk and the three of hearts is the moon.

He'll study a deck for about three minutes, mentally weaving together an intricate and fantastic story that will cue him as to the order of the cards.

Mirski said the strategy carries over to academic subjects that might seem intimidating at first, calling it "a reminder that the material isn't necessarily hard, it's the way you approach it."

Mirski, of Naperville, Ill., said he joined Penn's memory team as a way to add to his already eclectic repertoire of skills, including unicycling and solving Rubik's cubes.

But Dottino said such extracurricular clubs have proven a hard sell over the years, and he's at a loss to explain why. This year, there are four teams from Pennsylvania ? Penn, plus three groups related to Hershey High ? and Bergen Academies from Hackensack, N.J. The individual "mental athletes" represent a slightly wider slice of the country.

Hershey junior Nate Hamilton, 16, said he joined the memory team because his friends asked him to, and was quickly hooked by the camaraderie and relentless quest to challenge himself.

"Every time you hit a new personal best, you know you can improve it more," Hamilton said.

A group of Hershey moms who have watched their teens compete for years decided to join the contest this year. Dana Hamilton said her participation has spurred some "cool conversations" with son Nate about strategies ? exchanges she wouldn't have otherwise had.

But there's not much mother-child rivalry, she said. In fact, Dana Hamilton described the Hershey students as being supportive of their older ? but much less experienced ? parents.

"I don't think they're worried in the least about us coming to close to their scores," Hamilton said.

As the mists lift, a hint of the forbidden comes into view just 10 miles across the rough coastal seas. This is one of South Korea?s frontline outposts, located in the Yellow Sea near the Northern Limit Line, the very edge that divides blood brother and political foe North Korea.

But it was not always this way ? before the partition of North and South, the island group was one of four that belonged to the mainland province visible through the mists to the north, now part of an enemy state.

Though cut off from their brethren for six decades, some older island residents still recall a time when they could cross freely. On a cultural level, they carry on a culinary legacy by hosting some of the most authentic versions of a cold noodle dish that also belongs squarely to the North: mul naengmyeon.

On Baengnyeong, in simple restaurants, this icy concoction of buckwheat noodles, beef broth, thinly sliced radishes, and half a boiled egg, is served to a steady stream of island residents, tourists, and South Korean soldiers.

While many visitors are eager to catch a glimpse of the forbidden through binoculars, vestiges of lasting ties lurk beneath the surface of life here. Until relatively recently, visitors from North Korea were said to regularly drift across the precarious waters.

Romney looks to build lead with Illinois primary

(AP) ? There will be no knockout punch, but an increasingly confident Mitt Romney expects to tighten his grasp on the Republican presidential nomination with the Illinois primary.

Romney is surging in Illinois polls after the race was seen as a statistical tie just a week ago. He's riding momentum from a lopsided weekend victory in Puerto Rico punctuated by apparent missteps from rival rick Santorum on the eve of Tuesday's Illinois contest.

Romney's wife, Ann, suggested in recent days that Illinois voters could send a strong message that now is the time to coalesce behind one candidate. Romney is eager to move beyond the expensive and extended Republican contest to focus on President Barack Obama in the general election. But he's struggled to win over skeptical conservatives.

"I fully expect him to win ... and when he does, I think it'll be yet another step towards the nomination," said Rep. Aaron Schock, R-Ill., who campaigned alongside Romney on Monday. "You know this is the only candidate the White House fears about winning the nomination."

Romney has already captured more delegates than his opponents combined.

There are 54 delegates up for grabs in Tuesday's primary. But Santorum can't win 10 of them because his campaign didn't file the proper paperwork.

That means Romney is likely to win the delegate battle, even if he loses the popular vote. Still, Romney and his allies have spent a combined $3.5 million on Illinois television ads to try to prevent that from happening.

Santorum may not have helped himself Monday, when he suggested that neither the economy nor the unemployment rate was his top concern. He later explained his comments as being about freedom, not the economy.

"The problem with the economy is government taking people's freedom away and advancing regulations, destroying and undermining businesses ability to be problem solvers," he told Chicago radio station WLS. "Americans don't take kindly to the yoke of government, and we don't do very well. Our economy struggles when that happens."

The original comments sparked a rash of criticism that Romney picked up on at his final campaign stop of the day at Bradley University in central Illinois.

"One of the people who is running also for the Republican nomination today said that he doesn't care about the unemployment rate," Romney told college students in Peoria, Ill. "It does bother me. I want to get people back to work. I am concerned about those how are out of work."
